Spa & Wellness Kasprowy Regulations

  1. The owner and administrator of Spa & Wellness Kasprowy is Bachleda Hotel spółka z ograniczoną odpowiedzialnością (limited liability company) with its headquarters in Zakopane, ul. Krupówki 29 ("the Company"), address for deliveries: 34-500 Zakopane, Szymaszkowa Hotel Bachleda Kasprowy, entered into the National Court Register at the District Court for Kraków Śródmieście under KRS (National Court Register) number 000436617.
  2. The Spa & Wellness Kasprowy Regulations define the organisation and course of the process of using the services provided by Bachleda Hotel, in particular: 
    A. the principles and manner of the provision of services by Spa & Wellness Kasprowy, ensuring adequate availability and quality of these services, 
    B. the conditions based on which Spa & Wellness Kasprowy provides services to its Users, including the scope of the actions of its employees and the conditions of cooperation between employees and Users of the facility in order to ensure the efficient functioning, safety and comfort of its Users, 
    C. the rights and obligations of Spa & Wellness Kasprowy Users, 
    D. the rights and obligations of the Company.
  3. Spa & Wellness Kasprowy is open from Monday to Sunday from 8:00 to 22:00. The grounds of Spa & Wellness Kasprowy should be vacated by the closing time; otherwise, a penalty will be charged. In addition, at the closing time of Spa & Wellness Kasprowy, security has the right to ask you to leave the facility. The devices and attractions at the property are turned off at closing time.
  4. Spa & Wellness Kasprowy reserves the right to change the opening hours of the facility or specific attractions, as well as the right to exclude specific Spa & Wellness zones for guests and users if a group booking has been made. Spa & Wellness Kasprowy opening hours may also change due to holidays, current promotions, maintenance shutdowns, etc. All information about changes to opening hours will be posted at the Main Reception in advance. Changing the opening hours or excluding Spa & Wellness Kasprowy zones from access to guests and other users shall not give rise to any claims for damages.
  5. Staying at and using Spa & Wellness Kasprowy is voluntary. It is assumed that upon entering the facility, each User has read and voluntarily accepted the provisions of the Regulations and all other Instructions and orders related to ensuring safety on the premises that have been made public by posting on an information board before entering Spa & Wellness Kasprowy.
  6. The Spa & Wellness Kasprowy Regulations apply to all Users of the facility, and are used to maintain safety, order and cleanliness throughout the grounds.
  7. The facility is equipped with appropriate rooms (changing rooms) and elevators adapted for the disabled.
  8. Spa & Wellness Kasprowy is a partially monitored facility, which aims to improve the safety of persons on the grounds. By accepting the Regulations and Instructions, Users acknowledge that their stay at Spa & Wellness Kasprowy may be monitored, and that materials recorded in this manner on CCTV monitoring may be used in disputes, for example, regarding payments for attractions, the purchase of food, and compliance with these Regulations. The Company is the sole owner of the monitoring materials. The facility is monitored on a continuous basis to ensure the safety of clients and of the property of the Company, and the Company assures that the monitoring is carried out in a way that does not violate the personal rights and dignity of Users, and that the monitoring devices have not been installed in places such as toilets, shower rooms, changing rooms or saunas. More information on CCTV monitoring is also included in items 16 to 23 of these Regulations. 
  9. All persons on the grounds of the facility are required to immediately comply with all announcements.
  10. The management and staff of Spa & Wellness Kasprowy (including security staff) have the right to check the sobriety of persons entering or staying on the premises. Refusal to undergo such testing will result in expulsion from Spa & Wellness Kasprowy under pain of calling the Police.
  11. Devices and items that may be damaged or pose a risk are to be left in the cloakroom. It is recommended that you leave valuables at home, in the hotel room or safe, which is located at the Hotel Reception. The Company is not responsible for lost or stolen items.
  12. Persons who are in poor health, have poor fitness or feel unwell, and pregnant women should use Spa & Wellness Kasprowy facilities with extreme caution. The Company is not liable for any consequences caused by the use of Spa & Wellness Kasprowy by such individuals.
  13. Those who violate order or the provisions of these Regulations will be removed from the facility without the right to receive a refund of any fees they have paid.
  14. It is considered that the purchase of accommodation, a ticket, a pass or other form entitling the holder to enter Spa & Wellness Kasprowy is tantamount to reading and accepting the provisions of these Regulations.
  15. In the case of complaints, requests or grievances, please contact the manager of Spa & Wellness Kasprowy.
  16. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, ("the GDPR"), we inform that the controller of personal data is Bachleda Hotel spółka z ograniczoną odpowiedzialnością with its headquarters in Zakopane, ul. Krupówki 29, address for deliveries: 34-500 Zakopane, Szymaszkowa Hotel Bachleda Kasprowy, entered into the National Court Register at the District Court for Kraków Śródmieście under KRS (National Court Register) number 000436617 ("the Controller"). 
  17. We have appointed a Data Protection Officer (DPO) who can be contacted at the following e-mail address: iod.r.andrzejewski@szkoleniaprawnicze.com.pl
  18. The controller processes personal data for the following purposes and on the following legal grounds: 
    A. In order to book treatments and provide SPA & Wellness services – i.e. the conclusion and performance of a contract (legal basis: Article 6(1)(b) GDPR – applies to ordinary data); and in terms of so-called special category data (in certain situations, their processing may be necessary) – also based on your consent – Article 9(2)(a) GDPR); 
    B. To remind you of an appointment via SMS OR e-mail; other contact data – based on the consent of Article 6(1)(a) GDPR
    C. To fulfil the legal obligations incumbent on the Controller, for example, related to accounting or tax (the legal basis is Article 6(1)(c) GDPR); 
    D. For commercial/marketing purposes (including adaptation of sent content – profiling. We would like to explain that your personal data may be subject to profiling. We automatically perform analyses of and run statistics on your data in the form of, for example, treatment preferences, age, and how often you use treatments. The consequence of these activities may be the sending of marketing content or commercial information tailored to your preferences and needs. These decisions will not be based solely on automated processing, including profiling) – if you grant the above consent – the basis of Article 6(1)(a) GDPR in conjunction with Article 10 of the Polish Act on the Provision of Electronic Services and Article 172 of the Polish Telecommunications Law; 
    E. For statistical purposes, data analysis, customer satisfaction surveys (the basis for processing is the legitimate interest of the Controller – Article 6(1)(f) GDPR);
    F. Possibly for the purpose of pursuing/defending claims, which is our legitimate interest (Article 6(1)(f) GDPR); 
    G. To conduct CCTV monitoring of the SPA & Wellness grounds – i.e. to ensure safety and protection of property, pursuant to Article 6(1)(c) GDPR in relation to Article 22(2)(1) of the Polish Act of 26 June 1974 – the Labour Code, and Article 6(1)(f) GDPR, i.e. the Administrator's legitimate interest in ensuring safety and protection of property. The monitoring covers the following areas: swimming pool, Jacuzzi, bubbler pools, corridors, passageways, emergency exits and gym.
  19. We will store your data no longer than is necessary: 
    A. With respect to the performance of concluded contracts – for their terms, as well as after their performance until the time-bar of actions;
    B. In the scope of fulfilling legal obligations incumbent on the Controller in connection with conducting business and the performance of concluded contracts, including, in particular, tax obligations – until such obligations expire;
    C. In the scope of processing carried out based on consent – until it is withdrawn; 
    D. In the scope of data from CCTV monitoring – for a period of 30 days from the date of recording, and if the recording is or may be evidence in proceedings conducted on the basis of applicable law – for the period necessary under legal provisions; 
    E. In the scope of processing carried out on the basis of other legitimate interests of the Controller – until they are carried out or you object to such processing, unless there are legally justified grounds for continued processing of these data. 
  20. The recipients of the personal data will be: an external entity providing and supporting the ICT system – pursuant to a relevant contract entrusting the processing of personal data, and ensuring that the abovementioned entity employs adequate technical and organisational measures to ensure data protection. In addition, your data may be shared or transferred to the following categories of recipients:
    - companies providing IT support services for the Hotel;
    - companies providing accounting services for the Hotel;
    - companies providing legal services;
    - companies providing marketing services for the Hotel;
    - a security company (data from monitoring) – data from CCTV monitoring may be made available to persons who demonstrate the need to access the recordings (interest carried out by a third party), for example, persons injured in situations recorded by the system's cameras.
  21. Your data (in connection with the use of the processor's services) may be processed in the USA, i.e. outside of the European Economic Area. We would like to explain that as regards the USA, the European Commission determined an adequate level of data protection on the basis of Commission Implementing Decision (EU) 2016/1250 of 12 July 2016 pursuant to Directive 95/46/EC of the European Parliament and of the Council on the adequacy of the protection provided by the EU-U.S. Privacy Shield, enabling the transfer of personal data to entities that will join this programme.
  22. You have: 
    A. pursuant to Article 15 GDPR, the right to access your personal data, including the right to obtain a copy of the data;
    B. pursuant to Article 16 GDPR, the right to request rectification (correction) of personal data;
    C. the right to data erasure – applies within the conditions and on the terms specified in Article 17 GDPR, 
    D. the right to restrict processing – applies within the conditions and on the terms specified in Article 18 GDPR, 
    E. the right to data portability – applies within the conditions and on the terms specified in Article 20 GDPR, 
    F. the right to object to processing – applies within the conditions and on the terms specified in Article 21 GDPR, 
    G. the right to lodge a complaint with a supervisory authority (President of the Polish Personal Data Protection Office), 
    H. the right to withdraw consent to the processing of personal data (but only in relation to personal data that are processed on the basis of your consent – you have the right to withdraw consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing that was carried out on the basis of consent before the withdrawal thereof. Withdrawal of consent may be made in the same form in which the consent was granted).
    In order to exercise your rights, please send your requests to the e-mail address spa@kasprowy.pl. You can also contact the person responsible for personal data protection at the headquarters of the Hotel.
  23. The provision of data is voluntary, but often necessary, for example, to be able to conclude a contract with us or receive notifications. Failure to provide data may result, for example, in the inability to conclude/perform a contract.  
  24. The Company is not responsible for photos taken and made available online by bystanders and persons who are unrelated to the facility.
  25. There are four main accessibility zones for Users at Spa & Wellness Kasprowy: AQUA, RELAXATION, SPA and GYM.
  26. The AQUA, RELAXATION, SPA and GYM Zones are an integral part of the Hotel and Spa & Wellness Kasprowy, and the provisions of the General Regulations and these Regulations apply within its grounds.
  27. Fees for entrance to the above zones are charged in accordance with the facility's price list. In addition, Zones have been designated in regards to which Users, after taking into account their skills and those of anyone in their care, are required to implement an action plan: paddling pool area – up to 0.6m deep, swimming pool area – up to 1.2m deep, bubbler pools, and the sauna zone.
  28. If there are any inconsistencies between the general provisions of these Regulations contained in items 1 to 24 and the provisions concerning specific Zones, the provisions relating to individual Zones shall apply.
  29. AQUA ZONE: includes a swimming pool, cloakroom with showers, paddling pools, Jacuzzi, and two slides. 
    A. Use of the AQUA Zone is included in the price of accommodation for guests staying at the Hotel during their hotel day.
    B. Outside guests may use the AQUA Zone after paying a fee before entering the pool zone at the Spa & Wellness Kasprowy reception in the amount specified in the price list per person/day of use of the pool.
    C. The duration of use of the AQUA zone is the time from purchasing the ticket at the Spa & Wellness Kasprowy reception until the time of leaving the pool zone. The time is calculated automatically from the moment you are recorded at the gate (applies to outside guests).
    D. Persons who intend to enter the AQUA zone, irrespective of whether they will use the facilities located in the swimming pool area or paddling pools, are required to first change their footwear to clean rubber footwear, such as slides, and change into swimsuits. Cotton hotel slippers may not be used as footwear for using the AQUA zone.
    E. Access to the swimming pool hall is possible only in a generally accepted swimsuit. It is also recommended to use a swimming cap, particularly for persons with long hair. The swimsuit should, in particular, be close-fitted, meeting hygiene, aesthetic and moral requirements, not have zippers or other metal or plastic elements that may pose a risk to the health or safety of the user or cause water contamination, damage to swimming pool equipment elements, i.e. :
    * women – one or two-piece swimsuit, 
    * men – swimming trunks.  
    F. Before using the swimming pool complex, please thoroughly wash yourself in the shower and disinfect your feet in designated areas.
    G. Each time after using the toilet, you must thoroughly wash yourself in the shower and disinfect your feet in designated areas.
    H. It is prohibited to bring or consume alcohol (outside the bar and designated area), tobacco products, food, beverages, as well as sharp and dangerous elements, in particular glass elements (including cosmetics in glass containers) to the swimming pool complex.
    I. Children under 13 years of age may not use the swimming pool complex without adult supervision.
    J. Children over 13 years of age may use the swimming pool complex only with the consent of their guardians.
    K. Children or adults using diapers may only use the pool wearing special waterproof diaper pants.
    L. Irrespective of the provisions of point K, children under three years of age may use the pool wearing special waterproof diaper pants.
    M. Disabled persons who use wheelchairs may use the pool only with a guardian. Guardians who are not hotel guests are also required to purchase an admission ticket.
    N. Non-swimmers may only use areas designated for persons who are unable to swim.
    O. Guests are required to use the designated passageways to enter and exit the pool.
    P. The AQUA zone may not be used by those who:
         a) are under the influence of alcohol or drugs;
         b) are in poor health that may endanger them or others;
         c) have diseases of the upper respiratory tract or have difficulty breathing;
         d) have open wounds or skin diseases, e.g. ringworm, lichen;
         e) have dressing plasters or bandages on the body;
         f) suffer from epilepsy or infectious diseases;
         g) are allergic to disinfectants;
         h) suffer from diseases associated with cardiovascular failure;
         i) have excretory system disorders;
         j) do not have a proper swimsuit.
    Q. In the AQUA zone, it is strictly prohibited to:
         a) smoke cigarettes;
         b) run in the swimming pool area, as well as in corridors, the hall, pool troughs, cloakrooms and rooms with showers;
         c) consume food in the cloakroom, change room and pool hall;
         d) consume any beverages, including alcoholic beverages, outside the bar and designated area;
         e) consume drugs;
         f) use rescue equipment for purposes other than those intended;
         g) dive into the water;
         h) bring animals
         i) destroy swimming pool equipment and devices;
         j) contaminate water;
         k) raise false alarms;
         l) make excessive noise; 
         m) bring and use large floating equipment such as pontoons or mattresses;
         n) relieve yourself outside the toilet;
         o) enter and leave pool troughs outside of designated areas;
         p) cause situations that threaten the safety of persons using the swimming centre, in particular, swimming underwater and performing breath-holding exercises.
    R. Anyone who intentionally or unintentionally contaminates a pool will be charged with the costs of replacing the water in the pool and all costs associated with the need to close the pool due to it being contaminated. Parents or guardians are responsible for damage caused by minors in their care. 
    S. Persons destroying pool equipment or devices are liable for the damage caused in the full amount. Parents or guardians are responsible for damage caused by minors in their care.
    T. All persons who are within the grounds of the Pool are required to comply with the instructions of the staff and, in particular, the lifeguard on duty.
    U. Any cuts, injuries, perceived dangers and irregularities should immediately be reported to the lifeguard, and if this is not possible, to another Hotel employee.
    V. In an emergency, a lifeguard may order swimmers to leave the water immediately.
    W. Only authorised persons may enter in the lifeguard room. Entry by unauthorised persons is prohibited.
  30. RELAXATION ZONE: includes the following rooms: caldarium, tepidarium, aroma sauna, steam sauna, salt room, Zakopane sauna, Finnish sauna, and infrared sauna. 
    A. Before entering the sauna and bathhouse area, please remove all metal objects, as they may cause burns. 
    B. It is each user's responsibility to have towels. 
    C. Before entering the textile-free zone, swimwear is to be left in the change room and the body covered with a sheet or towel. In dry saunas, please spread the towel so that no part of your body is touching the wooden surface. 
    D. In the textile-free zone, the following is forbidden: entering wearing clothes, swimwear or footwear; lying down or sitting directly on the bench boards, i.e. without using a spread-out towel; running and making noise; loud conversations; jumping into the water; using the alarm bell without sufficient reason; bringing in alcoholic beverages; smoking; indecent behaviour; and behaviour considered socially inappropriate or offensive. 
    E. The textile-free zone designated in the Relaxation Zone is an area only accessible to adults, and the rest of the Relaxation Zone is also accessible to children over seven years of age, at designated times. 
    F. Anyone taking a bath in a sauna, bathhouse or pool does so at their own risk and responsibility. Anyone who is in a sauna or bathhouse declares their full physical and health capacity to use this type of treatment, and is responsible for the state of their health. 
    G. It is not recommended to take a bath in the sauna and bathhouse zone in the following cases: immediately after intensive training, for persons with cardiovascular diseases (varicose veins, previous myocardial infarction, ischaemia, hypertension), and for diabetics. 
    H. It is prohibited to use the sauna and bathhouse zone and the salt pool for persons whose external symptoms indicate infectious skin diseases and other infectious diseases (mycosis, papilloma, erythaema, erisypelas, etc.); with wounds that are open or difficult to heal; persons who lack personal hygiene; persons with difficulty breathing, impaired balance, or aggressive behaviour; women during menstruation; persons under the influence of alcohol or other drugs that reduce the body's abilities. 
    I. When using the saunas and bathhouses, it is essential that you comply with the instructions for use and information provided by Spa & Wellness Kasprowy employees.
  31. SPA ZONE: includes the following rooms: four SPA rooms and a VIP room with a sauna and Jacuzzi.
    A. Using the services of the Spa Zone requires completion and signing of a health questionnaire, and is tantamount to the client submitting a statement that they have no health-related contraindications for undergoing the procedure, and that they have read and accept the terms of these Regulations. 
    B. Clients of the SPA Zone must be adults, or minors only with the written consent of their parents or guardians; in such a case, the health questionnaire is to be completed by the parents or guardians. 
    C. All treatments are paid separately, as per the SPA price list. 
    D. If you intend to purchase a treatment, please let the SPA reception team know before the planned procedure.
    E. We recommend you book our services at least several days prior to your planned date. If you do not have a booking, you may use the services that are available at the time. Booking of a service takes place after the staff checks the availability of the time and date.
    F. Hotel guests may give instructions to transfer the payment for products and services purchased at the SPA to the room in which they are staying after pre-authorisation on a credit card at the Main Reception. This invoice will be settled on the day of checkout from the Hotel.
    G. Because we want to ensure the highest quality of services, clients are required to arrive 15 minutes before the agreed time of the treatment to complete a questionnaire. 
    H. The agreed time of the treatment is the starting time. Otherwise, the procedure will be shortened by the number minutes the client was late. 
    I. If a client books an appointment and does not show up for the procedure, they will be charged with an amount equal to 50% of the value of the procedure purchased. 
    J. The procedure can be cancelled, free of charge, at the SPA reception at least six (6) hours before the agreed time. 
    K. In the event of cancellation of the procedure less than six hours before the agreed time, the client will be required to pay an amount representing compensation for not cancelling the procedure in the amount of PLN 100 for every hour booked for the procedure.
    L. The team reserves the right to change the time of booked treatments 24 hours before the scheduled time. 
    M. Payments for services rendered in the SPA Zone are to be made at the hotel reception or at the SPA reception in cash or by a payment card. 
    N. The following persons will not be allowed to enter the SPA Zone:
    - anyone under the influence of alcohol,
    - anyone under the influence of drugs and other intoxicants, 
    - anyone behaving aggressively and inappropriately for the place in which they are.  
    O. The employees of the SPA Zone reserve the right to stop a procedure being performed if the client is behaving inappropriately for the area in which they are. In such a situation, the full fee for the procedure will be charged. 
    P. The Company is not responsible for any items left in the SPA zone (except for designated lockers). 
    Q. To increase the effectiveness of treatments, we recommend that you:
         a) inform the therapist before the treatment about:
         b) any medication you take,
         c) past diseases,
         d) possible contraindications
         e) use the pool, Jacuzzi and saunas always before the treatments;
         f) avoid heavy meals at least one hour before the treatment;
         g) avoid sunbathing immediately before and after the treatment;
         h) do not remove hair from your legs before peel treatments. 
    R. You should limit the intensity of sunbathing so that sunburn does not affect your comfort during treatments.
  32. GYM: includes the following rooms: cloakroom, room with fitness equipment.
    A. The Hotel's gym is available to Hotel Guests (as part of the fee paid for the stay and only during the period of a paid hotel day), and to outside guests after they pay the price specified in the Price List. 
    B. The Hotel does not refund money equivalent to services that were not used for reasons attributable to the client. 
    C. The gym may be used by the follow at their own risk (or at the risk of a guardian or group guardian – applies only to minors): 
         a) organised groups,
         b) sports clubs and divisions under the supervision of an instructor or coach after prior booking,
         c) individuals from 16 years of age.
    D. The gym may not be used by persons: 
         a) whose condition indicates alcohol consumption or who are under the influence of drugs, 
         b) who have medical contraindications, 
         c) who are under 16 years of age, except for the persons specified in point C.
    E. Persons using the gym are required to
         a) leave their outerwear and footwear in the cloakroom; 
         b) use proper sports footwear that is clean, and does not leave dirt or scratches etc. on the floor; 
         c) use a sports outfit and must use a clean and dry towel; 
         d) secure their valuables in a locker by themselves; 
         e) comply with safety rules when using sports equipment provided by the Gym; 
         f) comply with regulations related to health and safety, fire protection, and order; 
         g) immediately report information on breakdowns or damage to gym equipment to facility staff; 
         h) put the equipment back in its place after finishing an exercise; 
         i) maintain cleanliness and order within the grounds of the gym, cloakrooms and sanitary facilities; 
         j) comply with the instructions of employees responsible for the operation of the facility;
         k) not bring meals to the room that contains equipment.
    F. Within the grounds of the gym, including cloakrooms and sanitary facilities, it is prohibited to: 
         a) smoke, drink alcohol, and use drugs; 
         b) bring and use glass packaging and other glass items; 
         c) bring and use equipment that is not sports equipment; 
         d) bring in any type of dangerous object, explosives, pyrotechnic articles, or materials that pose a fire danger; 
         e) bring in animals;
         f) use gym equipment and devices in a way that threatens safety. 
    G. Only the persons using the gym are responsible (including financially responsible) for damages, accidents and other events arising during the use of the gym. In the case of minors, the guardian bears responsibility. 
    H. Hotel and Zone employees are authorised to control the behaviour of persons using the gym. 
    I. In the event of damage to property or other behaviour threatening the safety or health of participants or property security, the staff have the right to suspend exercises and order the individual(s) to leave the gym. 
    J. The Company is not responsible for valuables left at the gym outside of lockers.
